Stork Terms of Service

Welcome to Stork, a campus food delivery platform operated by DDRHS (“Company,” “we,” “us,” or “our”). Stork connects Virginia Tech students who want food delivered from on-campus dining halls and restaurants with student couriers who deliver it.

By creating an account or using the Stork mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use Stork.


1. Eligibility

1.1. General Requirements. To use Stork, you must be a current student or affiliate of Virginia Tech. Your account must be registered with a valid @vt.edu email address.

1.2. Courier Age Requirement. You must be at least 18 years of age to serve as a courier on the platform.

1.3. Verification. We may require you to verify your student status or identity at any time. Failure to verify upon request may result in account suspension.


2. Accounts

2.1. One Account Per Person. Each individual may maintain only one Stork account. Creating multiple accounts is grounds for termination.

2.2. Accurate Information. You must provide accurate, current, and complete information when creating your account and keep it updated.

2.3. Account Security. You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@storkdelivery.com if you suspect unauthorized access.

2.4. Account Deletion. You may delete your account at any time through the in-app settings.


3. How Stork Works

3.1. Platform Role. Stork is a marketplace platform that connects students who want food delivered (“Students”) with student couriers who deliver it (“Couriers”). Stork is not a restaurant, food provider, food preparer, or delivery company.

3.2. Two User Roles. Users may operate as a Student, a Courier, or both, subject to applicable eligibility requirements.

3.3. Availability. Stork is currently available exclusively to the Virginia Tech campus community. Service availability depends on courier availability, restaurant operating hours, and campus conditions.


4. Student Terms

4.1. Placing Orders. When you place an order through Stork, you are submitting a request for a courier to pick up food from your selected on-campus dining hall or restaurant and deliver it to your specified location.

4.2. Pricing and Fees. Prices displayed in the App include the food item price, a delivery fee, and a service fee. Tips for couriers are optional. All pricing is displayed before you confirm your order.

4.3. Payment Authorization and Capture. When you place an order, your payment method is authorized (a hold is placed on your card) for the order total. Your card is not charged until a courier accepts your order.

4.4. Cancellation.

  • (a) You may cancel an order at no cost if no courier has yet accepted it.
  • (b) Once a courier has accepted your order, cancellation fees may apply.
  • (c) Cancellation details and any applicable fees will be displayed in the App.

4.5. Food Quality and Safety. The food you receive is prepared by the restaurant you selected, not by Stork or the courier. Stork is not responsible for food quality, taste, temperature, allergens, nutritional content, or food safety.

4.6. Delivery Address. You must provide an accurate delivery address, including your building name and room number.

4.7. Order Receipt. You are responsible for promptly receiving your order upon the courier's arrival.


5. Courier Terms

5.1. Independent Contractor Status. Couriers are independent contractors and are NOT employees, agents, or representatives of Stork or DDRHS.

5.2. Identity Verification. Before accepting any delivery orders, couriers must complete identity verification by submitting a clear photo of their Virginia Tech student ID through the App.

5.3. Student Status. Couriers must maintain valid student status at Virginia Tech for the duration of their activity on the platform.

5.4. Earnings and Payouts. Courier earnings from completed deliveries accumulate in your in-app wallet balance. You may cash out your earnings at any time via Stripe Connect.

5.5. Food Handling. Couriers must follow reasonable food safety and handling practices, including:

  • (a) Transporting food in a safe and sanitary manner.
  • (b) Delivering orders promptly after pickup.
  • (c) Not opening, tampering with, consuming, or adulterating any food order.

5.6. GPS Location Tracking. During active deliveries, the App tracks your GPS location for order tracking and safety purposes.

5.7. Multi-Order Deliveries. Couriers may carry up to 2 orders from the same restaurant and up to 5 orders total from the same dining hall simultaneously.

5.8. Order Acceptance. Accepting an order is a commitment to complete that delivery.


6. Payments

6.1. Payment Processing. All payments on Stork are processed by Stripe, Inc. Stork does not directly store your full payment card details.

6.2. Platform Fee. Stork retains a platform fee, calculated as a percentage of the delivery fee, for each completed order.

6.3. Tips. Tips are optional. 100% of tips go directly to the courier. Stork does not take any portion of courier tips.

6.4. Refunds. Refund requests are handled on a case-by-case basis. Contact support@storkdelivery.com with your order details.

6.5. Stripe Issues. Stork is not responsible for payment processing failures, delays, or errors caused by Stripe, your bank, or your payment method.


7. Prohibited Conduct

You agree not to engage in any of the following:

  • 7.1. Identity Fraud. Impersonating another person or providing false information.
  • 7.2. Harassment. Harassing, threatening, or intimidating any user.
  • 7.3. Payment Abuse. Placing fraudulent orders, using stolen payment methods, or exploiting refund policies.
  • 7.4. Account Sharing. Sharing your account credentials with another person.
  • 7.5. Unauthorized Use. Using the platform for purposes other than ordering or delivering food.
  • 7.6. Food Tampering. Opening, consuming, or tampering with food orders as a courier.
  • 7.7. False Information. Deliberately providing false delivery addresses or fabricating delivery confirmations.
  • 7.8. Platform Manipulation. Attempting to manipulate, reverse-engineer, or exploit the App.

8. Chat and User Content

8.1. In-App Chat. Stork provides an in-app chat feature for communication between Students and Couriers regarding active orders.

8.2. Content Review. Stork may review chat messages for safety monitoring, dispute resolution, and enforcement of these Terms.

8.3. Content Ownership. You retain ownership of content you upload or share through Stork. By uploading content, you grant Stork a non-exclusive, worldwide, royalty-free license to store, display, and transmit that content solely as necessary to provide the service.

8.4. Content Standards. You must not share content that is illegal, obscene, threatening, defamatory, or that violates any other person's rights.


9. Limitation of Liability

9.1. Platform Only. Stork is a technology platform that connects Students with Couriers. Stork is not a restaurant, food producer, food handler, or delivery company.

9.2. Food Liability Exclusion. Stork is not liable for food quality, taste, temperature, allergens, contamination, foodborne illness, or any other food safety issue.

9.3. Delay Exclusion. Stork is not liable for delivery delays caused by restaurants, campus conditions, courier availability, or other circumstances beyond our reasonable control.

9.4. Maximum Liability. Stork's total liability is limited to the amount you paid for the specific order giving rise to the claim.

9.5. No Warranty. The App and service are provided “as is” and “as available” without warranties of any kind.

9.6. Consequential Damages. Stork shall not be liable for any indirect, incidental, special, consequential, or punitive damages.


10. Account Termination and Suspension

10.1. By Stork. We may suspend or terminate your account if we reasonably believe you have violated these Terms.

10.2. By You. You may delete your account at any time through the in-app settings.

10.3. Courier Earnings on Termination. Any outstanding wallet balance earned from completed deliveries will be paid out to your Stripe Connect account. You will have 30 days from the date of termination to connect one and request payout.

10.4. Effect of Termination. Upon termination, your right to use the App ceases immediately. Sections 6, 8.3, 9, 11, 12, and 14 survive termination.


11. Dispute Resolution

11.1. Informal Resolution First. Before initiating any formal dispute resolution proceeding, you agree to first contact us at support@storkdelivery.com and attempt to resolve the dispute informally for at least 30 days.

11.2. Binding Arbitration. If informal resolution fails, any dispute shall be resolved by binding arbitration administered under the rules of the American Arbitration Association in the Commonwealth of Virginia.

11.3. Class Action Waiver. You agree that any dispute resolution proceeding will be conducted only on an individual basis and not as part of a class, consolidated, or representative action.

11.4. Small Claims Exception. Either party may bring an individual action in small claims court in the Commonwealth of Virginia.

11.5. Governing Law. These Terms shall be governed by the laws of the Commonwealth of Virginia.


12. Intellectual Property

12.1. Stork Property. The Stork name, logo, brand elements, App design, source code, algorithms, and all other content created by Stork or DDRHS are the exclusive property of DDRHS. All rights are reserved.

12.2. Restrictions. You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works based on the App without prior written consent.

12.3. Feedback. If you provide suggestions, ideas, or feedback about Stork, you grant us a perpetual, irrevocable, royalty-free license to use that feedback for any purpose.


13. Changes to These Terms

13.1. We may update or modify these Terms at any time. When we make material changes, we will notify you at least 14 days before the changes take effect.

13.2. Your continued use of Stork after the effective date of updated Terms constitutes acceptance.

13.3. The current version of these Terms is always available within the App and at storkdelivery.com/terms.


14. Miscellaneous

14.1. Severability. If any provision is found to be unenforceable, the remaining provisions shall continue in full force.

14.2. Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Stork.

14.3. No Waiver. Our failure to enforce any provision does not constitute a waiver.

14.4. Assignment. You may not assign your rights without our prior written consent. Stork may assign these Terms without restriction.

14.5. Force Majeure. Stork shall not be liable for any failure due to circumstances beyond our reasonable control.

14.6. Notices. Notices to you will be sent to the email address associated with your account. Notices to Stork should be sent to support@storkdelivery.com.
